Cancellation & Refund Policy

This Cancellation & Refund Policy applies to payments made directly to North Coast Elite Realty for services including vacation rental management, property management, property marketing, listing and channel management, pricing strategy, consultation, setup, onboarding, and other related services.

This policy does not automatically apply to property reservation deposits, purchase deposits, installment payments, guest booking payments, or other funds paid to or controlled by developers, builders, sellers, property owners, booking platforms, financial institutions, or other independent third parties.

By purchasing or engaging a paid service from North Coast Elite Realty, you acknowledge this policy together with any applicable proposal, invoice, service agreement, management agreement, or other written agreement.

1. Service Fees

North Coast Elite Realty may charge fees for services including:

  • Vacation rental management

  • Property management

  • Listing creation and optimization

  • Booking channel management

  • Pricing and revenue strategy

  • Property marketing

  • Digital advertising management

  • Property onboarding

  • Setup and administrative services

  • Consultations

  • Other agreed real estate or property-related services

The price, scope of work, payment schedule, and service period may be established through an invoice, proposal, management agreement, service agreement, or other written confirmation.

2. Cancellation of Ongoing Services

Clients may cancel ongoing North Coast Elite Realty services by providing written notice.

Unless a separate signed agreement provides otherwise, ongoing vacation rental management and property management services require thirty (30) days' written notice of cancellation.

The client remains responsible for fees attributable to services performed, work in progress, authorized expenses, third-party costs, and other amounts properly incurred before the effective cancellation date.

Cancellation applies prospectively and does not retroactively cancel or reverse services already provided.

3. Services Already Performed

Fees attributable to services already completed or substantially performed are generally non-refundable, subject to applicable law.

This may include:

  • Listing creation

  • Listing optimization

  • Property onboarding

  • Booking platform setup

  • Channel configuration

  • Pricing analysis

  • Revenue strategy

  • Marketing preparation

  • Advertising setup

  • Website or landing-page work

  • Content preparation

  • Administrative services

  • Consultations

  • Account configuration

  • Other completed or substantially performed work

A client's cancellation after work has commenced does not automatically entitle the client to a full refund.

4. Setup and Onboarding Fees

Setup and onboarding fees compensate North Coast Elite Realty for initial work required to prepare a property or account for management or marketing.

This may include account setup, listing preparation, platform configuration, property information organization, pricing setup, marketing preparation, and administrative work.

Once setup or onboarding work has begun, the portion of the fee attributable to work already performed or committed costs is generally non-refundable.

5. Monthly Management Fees

Monthly management fees compensate North Coast Elite Realty for services provided during the applicable management period.

Cancellation does not automatically create a right to reimbursement of management fees attributable to services already provided.

Future management fees will cease according to the applicable cancellation period and the terms of the client's management agreement.

6. Marketing, Advertising and Third-Party Expenses

Clients may be responsible for authorized expenses incurred in connection with their property or services.

These may include:

  • Paid advertising

  • Photography or videography

  • Booking platform charges

  • Software or technology costs

  • Website-related expenses

  • Promotional expenses

  • Contractor expenses

  • Payment processing charges

  • Other approved third-party costs

North Coast Elite Realty is not required to refund third-party expenses that have already been authorized, committed, or paid and are not recoverable from the third-party provider.

If a third party refunds an expense, any amount properly due to the client will be handled according to the applicable agreement and circumstances.

7. Client Delays or Failure to Provide Required Information

Clients are responsible for providing information, property access, photographs, documents, approvals, account permissions, platform credentials or access, and other materials reasonably required for North Coast Elite Realty to perform the agreed services.

If services are delayed because required information or access has not been provided, North Coast Elite Realty may pause affected work.

A client-caused delay does not automatically create a right to a refund for work already completed, time already incurred, or authorized costs already committed.

8. Change of Mind

A decision to discontinue a service or change plans after North Coast Elite Realty has begun or completed work does not, by itself, create an automatic right to a refund.

Refund eligibility will depend on:

  • Services already performed

  • Work already in progress

  • Authorized expenses incurred

  • Third-party commitments

  • The applicable service agreement

  • The circumstances surrounding the cancellation

  • Any mandatory rights provided by applicable law

9. Vacation Rental Guest Cancellations

This policy primarily governs fees paid for North Coast Elite Realty's management and related services.

It does not automatically determine cancellation or refund rights for guests who reserve vacation rental accommodations.

Guest reservations may be governed by:

  • The property's cancellation policy

  • The applicable rate plan

  • The rental agreement

  • The booking platform's policies

  • The terms accepted by the guest when booking

North Coast Elite Realty cannot override the policies of an independent booking platform except where permitted by that platform or applicable agreement.

10. Property Reservation Deposits

Property reservation deposits are separate from North Coast Elite Realty's service fees.

A reservation payment for a property may be governed by the terms established by the applicable:

  • Developer

  • Builder

  • Seller

  • Property owner

  • Attorney or escrow provider

  • Financial institution

  • Purchase or reservation agreement

Whether a property reservation deposit is refundable depends on the applicable transaction documents.

Buyers should review those terms carefully before transferring funds.

11. Pre-Construction Property Payments

Pre-construction transactions may require reservation deposits, down payments, installment payments, construction payments, or final payments.

Cancellation and refund rights for these payments are governed by the applicable reservation agreement, purchase agreement, developer agreement, or other transaction documents.

Those agreements may contain specific provisions concerning:

  • Buyer cancellation

  • Developer cancellation

  • Reservation deposits

  • Non-refundable amounts

  • Installment payments

  • Default

  • Construction delays

  • Administrative charges

  • Contract transfers or assignments

  • Refund eligibility

North Coast Elite Realty does not independently guarantee that a developer, builder, seller, or property owner will refund a property-related payment.

12. Payments Made Directly to Third Parties

North Coast Elite Realty cannot issue a refund for funds it does not receive or control.

This includes payments made directly to:

  • Developers

  • Builders

  • Sellers

  • Property owners

  • Booking platforms

  • Attorneys

  • Escrow providers

  • Banks or financial institutions

  • Contractors

  • Payment providers

  • Other independent third parties

A refund request involving such funds generally must be directed to the party that received or controls the payment.

North Coast Elite Realty may assist with reasonable communication where appropriate, but we cannot guarantee approval, timing, or payment of a third-party refund.

13. Refund Requests for North Coast Elite Realty Services

Refund requests concerning payments made directly to North Coast Elite Realty must be submitted in writing.

The request should include:

  • Full name

  • Contact information

  • Service purchased

  • Payment date

  • Amount paid

  • Invoice or transaction information

  • Reason for requesting the refund

We may request additional information reasonably necessary to verify the transaction and evaluate the request.

Submission of a refund request does not automatically mean that a refund is due or will be approved.

14. Approved Refunds

If a refund is determined to be due, North Coast Elite Realty will generally return the applicable amount through the original payment method where reasonably possible.

Processing times depend on the bank, card issuer, payment processor, or financial institution and may be outside our control.

Any third-party processing charges or other costs will be handled in accordance with applicable law and the applicable payment provider's terms.

15. Duplicate and Incorrect Charges

If a client believes they were charged twice for the same North Coast Elite Realty service or charged an incorrect amount, they should contact us promptly.

Verified billing errors will be corrected as appropriate.

16. Chargebacks and Payment Disputes

Clients are encouraged to contact North Coast Elite Realty promptly regarding billing concerns so that we have an opportunity to investigate and resolve the issue.

Nothing in this policy prevents a client from exercising lawful rights available through a financial institution, card issuer, payment processor, or applicable consumer-protection law.

In the event of a payment dispute or chargeback, North Coast Elite Realty reserves the right to provide relevant documentation demonstrating the transaction and services provided, including:

  • Signed agreements

  • Invoices

  • Payment records

  • Client communications

  • Approvals

  • Work records

  • Marketing records

  • Platform activity

  • Deliverables

  • Evidence of services performed

17. No Guarantee of Results

North Coast Elite Realty provides services and professional efforts according to the agreed scope of work.

Payment for our services does not purchase or guarantee a particular financial or business result.

We do not guarantee:

  • A specific number of bookings

  • Specific occupancy

  • Specific rental revenue

  • Property appreciation

  • A particular return on investment

  • Sale of a property within a particular period

  • A particular booking-platform ranking

  • Specific advertising results

  • Financing approval

  • Future market performance

Real estate, tourism, rental demand, online platforms, advertising, and market conditions involve factors outside our control.

Failure to achieve a particular anticipated result does not, by itself, establish entitlement to a refund where the agreed services were properly performed.

18. Termination by North Coast Elite Realty

To the extent permitted by the applicable agreement and law, North Coast Elite Realty may suspend or terminate services in circumstances including:

  • Non-payment

  • Fraud or suspected fraudulent activity

  • Material breach of an agreement

  • Unlawful activity

  • Intentional misrepresentation

  • Abusive or threatening conduct

  • Misuse of our services

  • Failure to provide information or access reasonably required to perform the service

Any outstanding balance or refund due following termination will be determined according to the applicable agreement, services performed, authorized costs incurred, and applicable law.

19. Outstanding Fees Following Cancellation

Cancellation does not eliminate amounts properly owed for services performed or authorized expenses incurred before the effective termination date.

Where permitted by the applicable agreement and law, clients remain responsible for outstanding invoices and amounts properly due for completed services, work performed during the cancellation period, and authorized third-party expenses.

20. Existing Vacation Rental Reservations After Termination

Termination of management services does not automatically cancel existing guest reservations.

The handling of existing and future reservations following termination will be determined by the applicable management agreement, booking platform requirements, property cancellation policies, and the circumstances of each reservation.

Property owners remain responsible for ensuring that existing guest obligations are properly honored or transferred where required.

North Coast Elite Realty will not intentionally cancel confirmed guest reservations solely because a management relationship ends unless authorized or otherwise required.

21. Separate Agreements Take Priority

A specific management agreement, service agreement, marketing agreement, proposal, reservation agreement, purchase agreement, or other signed contract may contain cancellation, payment, or refund provisions specific to that relationship.

Where a signed agreement governs a particular transaction or service, that agreement will control to the extent it conflicts with this general website policy, subject to applicable law.

22. No Waiver of Mandatory Rights

Nothing in this Cancellation & Refund Policy is intended to eliminate or restrict a right that cannot legally be excluded or limited.

If any provision of this policy is determined to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

23. Changes to This Policy

North Coast Elite Realty may update this policy periodically to reflect changes in our services, business practices, or applicable requirements.

Any revised version will be published on our website with an updated Last Updated date.

Changes will apply prospectively and will not automatically replace different cancellation or refund terms contained in an existing signed agreement.
